Are workers forced to work overtime under threat of penalty?
fl-7--1
Recommendations
- Employers must allow workers to freely decide whether to accept overtime work without facing penalties.
- Supervisors should never threaten workers with job loss, wage reductions, or other consequences for refusing overtime.
- Workers must be fairly compensated for all overtime hours worked at legally mandated premium rates.
- Overtime should never be used to cover minimum wage shortfalls. Regular labor audits and anonymous worker surveys should be conducted to detect potential violations of overtime policies. Facilities must implement corrective action plans if forced labor indicators are identified.
